How the amendment process works

Council meeting
Resolution to seek authorisation from the Minister for Planning to prepare and exhibit an amendment

Authorisation may or may not be granted by the Minister for Planning, or may granted subject to conditions.

Public exhibition
Opportunity for the public, and other key stakeholders, to make a written submission in support of, or objection, to the proposed amendment
-
Council meeting
Consideration of all written submissions. Council must then decide to either:
- change the amendment in the manner requested
- refer submissions to an independent Panel for review
- abandon all or part of the amendment

Panel hearing
Consideration of the submissions by an independent Panel, appointed by the Minister for Planning

Council Meeting
Consideration of the Panel's findings and recommendations. Council must then decide to either:
- adopt the amendment (with or without changes), or
- abandon all or part of the amendment

Submission of final adopted amendment by Council to the Minister for Planning for approval

Minister for Planning approves or refuses the amendment

On 28 February 2022, Melbourne Water submitted a formal request to Manningham Council for a Planning Scheme Amendment under Section 20(2) of the Planning and Environment Act 1987.
The corrective amendment request sought to remove or amend the extent of Special Building Overlay - Schedule 1 (SBO1) in the Manningham Planning Scheme, as it applied to properties in and around Hillcroft Drive, Templestowe.
Council resolved to adopt Amendment C137mann and seek authorisation from the Minister for Planning at its 26 April 2022 meeting.
Notice of the approval of Amendment C137mann appeared in the Government Gazette on 18 November 2022.
The revised SBO1 mapped area can now be viewed on the Department of Environment, Land, Water and Planning (DELWP) website.
Manningham Council is announcing the commencement of the public exhibition of a planning scheme amendment C127mann and concurrent planning permit application PLN20/0303 for land at 674 to 680 Doncaster Road, 2 Short Street and 14, 14A, 16 and 18 Hepburn Road in Doncaster.
The exhibition period will be from Thursday 10 June to Monday 12 July 2021.
The amendment request and planning permit application has been made by Hollerich Town Planning Pty Ltd on behalf of the landowner, The Properties Corporation of the Churches of Christ to facilitate the future development of the site.
The request proposes the partial demolition of the existing heritage listed church, the construction of a 17-storey mixed-use development comprising 177 dwellings, a place of assembly, child care centre, two food and drink premises, offices, a reduction in the standard car parking requirements and to alter the access arrangements to a road in a Road Zone, Category 1. Ten of the dwellings within the development are also proposed for affordable housing.
If Planning Permit Application PLN20/0303 is approved, a Section 173 Agreement will secure the provision of ten affordable housing dwellings within the development. Manningham Council will welcome submissions from any person who may be affected by Amendment C127mann, Planning Permit Application PLN20/0303, or the draft Section 173 Agreement.
Manningham Mayor, Cr Andrew Conlon said that consultation on planning within Manningham is crucial to understand what our community cares about.
“Good community engagement is helping people have a say on any Council decision that impacts them. Please make a submission on this planning scheme amendment or permit for a mixed use building if you have anything you’d like to contribute.”

All residents and interested parties have an opportunity to lodge submissions. Council will consider all submissions at a future Council meeting as part of the amendment process.

We are reviewing the Manningham Planning Scheme and want your input.
The Planning Scheme guides the use, development, and protection of land in Manningham. It includes written policies, as well as maps showing where zones and overlays apply across the municipality.
The Scheme is made up of many planning policies and controls that are set by the State Government. This review seeks to identify changes to the planning scheme associated with the provisions that we are able to influence.
The Planning Scheme includes the following key themes:
- Residential/ neighbourhood character.
- Environment/rural areas.
- Activity Centres.
- Employment.
- Heritage, arts, cultural and leisure.
- Transport and car parking.
All Victorian local governments are required to review their planning scheme every four years under the Planning and Environment Act 1987. We are looking for feedback about:
- What aspects of the Planning Scheme are working well?
- What aspects of the Planning Scheme need improving?
- What is missing from the Planning Scheme?

Manningham residents and other interested parties are invited to a drop-in session on Thursday 9 June between 4pm and 7pm at the Manningham Civic Centre, 699 Doncaster Road, Doncaster. You can also provide feedback via an online survey.
