VicSmart is a simpler and fast Planning Permit process for straightforward applications. For an application to be considered under VicSmart, it must form part of the State Government's limited classes of applications outlined in Clause 92.03 of the Manningham Planning Scheme. Applications are not required to be advertised and in most instances will be processed within 10 business days of receipt.

The types of applications include:

  • Realign a boundary between two lots
  • Subdivide land into lots each containing an existing building or car parking space
  • Subdivide land with an approved development which has started into two lots
  • Subdivide land into two lots in a rural zone, where the minimum lot size is met
  • Construct a front fence in a residential zone
  • Construct building or works in a Activity Centre, Commercial, Industrial or Mixed Use Zone (cost limits apply)
  • Construct a front fence in an Overlay
  • Remove, destroy or lop one tree
  • Minor subdivision, minor buildings and works, painting or tree lopping in a Heritage Overlay
  • Minor subdivision or buildings and works in a Special Building Overlay
  • Display limited signs in a Activity Centre, Commercial or Industrial Zone
  • Reduce car parking requirement for no more than 10 spaces
  • Reduce or waive the loading and unloading requirements

Amending Permits and Plans

A person entitled to use or develop land in accordance with a Planning Permit can request Council to amend a permit. An amendment to a permit may consist of changes to what the permit allows, any permit conditions or approved documentation and plans. The process for considering such applications (under Section 72 of the Planning and Environment Act 1987) is very similar to the new application process and requires the submission of a form, specific documentation and the payment of a statutory fee.

Minor matters and discrepancies shown on approved plans can be approved without following the full Amended Permit process. These amendments are known as 'secondary consent' and may be made at the discretion of Council and the relevant Planning Officer. A secondary consent amendment request requires the submission of a request form listing the proposed changes, and supply amended plans electronically to planningapplications@manningham.vic.gov.au with plan changes clearly highlighted and the associated fee.

Prior to the submission of an amendment to a permit, you are advised to speak to the responsible Planning Officer to determine whether your amendment should be submitted to Council as an application to amend a permit (Section 72) or whether it can be considered under the secondary consent provisions of the permit.
